The state sought adjudication of wardship against Michael, charging him with misdemeanor theft. Count I alleged that he obtained control over property of another under circumstances that would have reasonably induced him to believe that it was stolen. Count 2 alleged that he committed theft by deception. Following Michael’s conviction on Count 2, the probation officer recommended that Michael be placed on supervision for one year. The state recommended a sentence of one year’s probation and restitution of $160. The court continued the case under supervision for one year, referred Michael for evaluation, and ordered him to pay $160 in restitution. The continuance was memorialized in a “Supervision Order” and a “Sentencing Order.” On the sentencing order, the judge checked the box for “No finding or judgment of guilty entered.” The court did not adjudge Michael a ward of the court, but advised Michael of his appeal rights, and appointed the State Appellate Defender to represent him. The Illinois Supreme Court affirmed the appellate court’s dismissal for lack of jurisdiction. While a recent statutory change allows supervision orders to be entered in juvenile cases after a finding of guilt (705 ILCS 405/5-615(1)(b)), the change did not make such interlocutory orders appealable under any supreme court rule. M.A., then 13 years old, fought with her 14-year-old brother and cut him with a kitchen knife. M.A. was adjudicated delinquent of several offenses and ordered to register under the Murderer and Violent Offender Against Youth Registration Act, 730 ILCS 154/1. M.A. argued that the registration provisions violated her rights to substantive and procedural due process and equal protection. The Appellate Court rejected the substantive due process claim, but found the registration provisions unconstitutional for violating procedural due process and equal protection. The Illinois Supreme Court reinstated the registration requirement. Current dangerousness is not relevant to the duty to register, so M.A. did not have a due process right to a hearing to address that issue. The Act requires registration solely based upon the fact of conviction or adjudication, which M.A. had a procedurally safeguarded opportunity to contest during her juvenile adjudication proceedings. M.A. did not challenge her adjudication as a juvenile delinquent on appeal. Given that the charges for which M.A. is required to register would be felonies if M.A. committed those acts as an adult, and that those charges require a finding that the offender caused “great bodily harm, permanent disability, or disfigurement,” there is a rational relationship between M.A.’s registration and protection of the public. The state filed a juvenile delinquency petition charging Q.P. with obstructing justice (720 ILCS 5/31-4(a)). Officer Irving testified that he responded to a report of a vehicle burglary in progress, arrived at the scene, and observed a person (Q.P.) matching the description given in the report. Irving placed him in the squad car. Q.P. stated his name was Antwan Ellis and offered to direct Irving to his residence. At the address given by Q.P., Irving spoke to a woman who stated she did not know anyone named Antwan. They approached the squad car and the woman stated she had dated Q.P.’s father and she knew him as Q. P.. Q.P. then gave his correct name, but misspelled both names. Irving transported Q.P. to the police station and discovered that Q.P. was a runaway. The circuit court found Q.P. guilty of obstructing justice. The appellate court reversed, holding that Q.P. was already apprehended when he gave false information, and a person already apprehended cannot act with the intent to prevent apprehension. The Illinois Supreme Court reinstated the conviction. Q.P. gave false information shortly after he was placed in the squad car. At that point, Irving did not know about the juvenile warrant. Q.P. told a police detective that he gave the false name because he knew there was a warrant for his arrest. A rational trier of fact could have found Q.P. provided the false name with the intent to prevent his apprehension on the juvenile warrant. . View "In re Q.P." on Justia Law

Then 23-year-old Fiveash was charged with aggravated criminal sexual assault and criminal sexual assault, based on his sexual penetration of the vagina and mouth of his 6-year-old cousin, P.A., in 2003, when he was 14-15 years old. Fiveash was certified to teach grades 6 through 12 and had been teaching part-time at two schools. He moved to dismiss, arguing that the Juvenile Court Act (705 ILCS 405/5-120) gave the juvenile court “exclusive jurisdiction” over offenses allegedly committed when he was 14, barring prosecution in criminal court, and that he could not be prosecuted in juvenile court because he was over 21. The trial court dismissed, finding the result “unjust, absurd, and clearly unfair to the victim.” The appellate court construed the language in section 5-120 as barring criminal proceedings only against defendants under the age of 21 for offenses they allegedly committed while under the age of 17. Because defendant was 23 when indicted, the court concluded section 5-120 did not apply, and reversed and remanded for trial in adult criminal court. The Illinois Supreme Court affirmed. Section 5-120 does not bar prosecution in criminal court for offenses allegedly committed when a defendant was 14 or 15 but not charged with until he was over 21 and not subject to the Act. The state filed a petition for adjudication of wardship, alleging that D. had committed first degree murder. D. was nine years old; the victim was 14 months old. The circuit court found D. unfit to stand trial and subsequently found him “not not guilty” of murder. Thecourt remanded D. to the Department of Human Services for fitness restoration education, so that D. may become fit and be tried for murder. The appellate court reversed, finding that the trial court erred in denying a suppression motion. The Illinois Supreme Court remanded for “harmless error analysis,” noting that in interviewing D., a detective seized on D’s fear that his father or others in the household would go to jail, or that he, himself, would be taken away. The detective promised D that no matter what he said, no one was going to jail, no one would be in trouble, he would not be taken from his father and, at the end of the day, he could go to his grandmother’s house and “hang out” with his dad. The detective reinforced that no consequences would follow an admission that D hit the victim and rejected repeated denials, making plain that anything less than an admission was unacceptable. The detective stated that whatever happened was a mistake, and everybody makes mistakes, and was explicit about the admission that would suffice—an admission that D. hit the baby once .D eventually admitted to hitting the infant once. D., functioning at the level of a seven- or eight-year-old, was especially vulnerable and susceptible to police coercion. View "In re D.L.H." on Justia Law

Defendant was indicted in 2013 for criminal sexual assault and criminal sexual abuse, based on acts he allegedly committed in 2012, when he was 17 years old. At the time of the alleged offenses, the Juvenile Court Act only applied to those minors under 17 years of age, with limited exceptions. Effective January 1, 2014, the exclusive jurisdiction provision of the Juvenile Court Act was amended to apply to minors who were under 18 years of age, 705 ILCS 405/5-120, with a saving clause: “[t]he changes …apply to violations or attempted violations committed on or after the effective date of this amendatory Act.” Defendant filed, in 2014, a “Motion to Declare Adult Prosecution Unconstitutional,” alleging that the saving clause violated his equal protection rights under the federal and state constitutions. Defendant argued that he was similarly situated to 17-year-olds who allegedly committed offenses on or after the amendment’s effective date and there was no rational basis to treat him differently. The circuit court granted defendant’s motion, finding no rational basis for the different treatment. The Illinois Supreme Court reversed; it was reasonable for the legislature to distinguish between the two groups since applying the amendment to offenses committed before the effective date would require those cases to be transferred to the juvenile division and to begin anew. The state charged a 16-year-old (Jordan) with three counts of unlawful use of a weapon (AUUW) 720 ILCS 5/24-1.6, and one count of unlawful possession of a firearm (UPF), alleging that he carried in a vehicle an uncased, loaded, and immediately accessible firearm (24-1.6(a)(1), (a)(3)(A)); carried a handgun in a vehicle while under 21 years of age (24-1.6(a)(1), (a)(3)(I)); and carried a firearm in a vehicle without a valid FOID card (24-1.6(a)(1), (a)(3)(C)). The UPF count alleged that Jordan, under 18 years of age, knowingly possessed a firearm of a size which may be concealed upon the person (24-3.1(a)(1). Jordan moved to dismiss, contending that the AUUW statute had been found unconstitutional by the Seventh Circuit in 2012, as violating the second amendment right to bear arms for self-defense outside the home. The circuit court dismissed the AUUW counts, but denied the motion as to the UPF count. The state conceded that one count had been properly dismissed but argued that the remaining counts remained constitutionally valid because they required proof of independent aggravating factors. The Illinois Supreme Court affirmed dismissal of the first count based on section 24-1.6(a)(1), (a)(3)(A), which it found to be facially unconstitutional in 2013; reversed dismissal of charges based on sections 24-1.6(a)(1), (a)(3)(C) and (a)(3)(I), which are severable from the unconstitutional provision. Defendant was 15 years old and was a ward of the state, living in a residential treatment facility when he was charged with three counts of aggravated criminal sexual assault against a staff member. Pursuant to the Illinois automatic transfer statute (705 ILCS 405/5-130), his case was transferred from juvenile court to criminal court, where he was tried as an adult, convicted by a jury of all three counts, and sentenced to a total of 36 years in prison. The appellate court remanded for a new trial, holding that the circuit court had erred by admitting defendant’s confession. The court also concluded that evidence of the victim’s sexual history was admissible on remand under the “constitutional necessity” exception to the state rape shield statute (725 ILCS 5/115-7(a)). The Illinois Supreme Court reversed the appellate court’s exclusion of defendant’s confession and determination that evidence of the victim’s sexual history is admissible under an exception to the rape shield statute, rejected his ineffective assistance claim, and upheld the constitutionality of the automatic transfer statute. The trial court concluded that section 5-615 of the Juvenile Court Act, 705 ILCS 405/5-615, was unconstitutional, and ordered a continuance under supervision in a case involving a minor, rejecting a negotiated plea agreement. The minor had been the subject of multiple charges and had failed to appear for court dates. The Illinois Supreme court vacated. The provision at issue grants a State’s Attorney, among others, authority to object to the entry of an order of continuance under supervision in a juvenile case before a finding of guilt. The court noted that juvenile proceedings are fundamentally different from criminal proceedings, a difference which extends to the role of the state. The purposes and objectives of the Juvenile Court Act are protective in nature, to correct and rehabilitate, not to punish, and the Act lists the State’s Attorney among those who would undoubtedly be concerned with the children’s best interests. The State’s Attorney has a duty to see that justice is done not only to the public at large, but to the accused as well. The day after N’s birth, the baby’s mother, Nichole, and her boyfriend, Alfred, executed a voluntary acknowledgement of paternity (VAP), expressly imposing responsibility on Alfred to provide financial support. The VAP did not grant Alfred a right to custody or visitation, but it did provide him the right to seek custody or visitation. Alfred was also entitled to notices of adoption proceedings. Both Nichole and Alfred had the right to rescind the VAP within 60 days. The VAP explicitly waived Alfred’s right to genetic testing. Three days later, the Department of Children and Family Services (DCFS) took N into protective custody. DCFS filed a petition alleging juvenile neglect, identifying Nichole as N’s mother and Alfred as N’s father. The circuit court entered an order for temporary shelter care, placed N in the custody of DCFS, appointed a guardian ad litem (GAL), entered an order identifying Alfred as the “legal” father based on the VAP, and appointed separate counsel for Nichole and Alfred. Following genetic testing, the court granted the state’s motion and dismissed Alfred, based on evidence that he is not N’s biological father. The appellate court reversed, holding that the state did not have standing in a juvenile neglect proceeding (705 ILCS 405/1-1) to challenge the paternity of a man who signed a VAP under the Illinois Parentage Act of 1984 (750 ILCS 45/1).
